KULT.re owns the intellectual property of the FOCUSED brand, the focused.nu website (the ‘Site’) and the right to display all the elements of them. Everything on focused.nu, including designs, images, drawings, graphics, and text, is protected by worldwide copyright as well as other proprietary laws and treaty provisions. Consequently, total or partial reproduction of the elements contained on the focused.nu website, the use of such elements and the fact to make them available to third parties are strictly prohibited. Please contact us for information about availability of materials used on the focused.nu website.

2. PRODUCT

KULT.re offers its own unique design furniture constructed from recycled skateboards under the brand FOCUSED. Each FOCUSED product shown by KULT.re on focused.nu is described in detail and photographed. KULT.re reserves the right to show all the FOCUSED products as exact as possible but we do not guarantee that the products seen on screen are the same in reality. We want to stress that the colors of FOCUSED products are dependent on the available skateboards that have been collected. Specific color variations cannot be guaranteed. The color pattern of every FOCUSED product will be unique. Please note that we reserve the right to alter minor details of the products featured on focused.nu and in other informational materials we provide in the interest of maintaining product quality and design integrity.

Accordingly, products shipped to you may differ slightly from those depicted on this site or in such materials. The buyer is responsible for the correct assembly of the supplied products following instructions shipped within the packaging.

All the Products available on the focused.nu website are subject to the availability at the time of the order. The Customer will be informed if the product requested is not available. KULT.re retains ownership of the products until our products have been fully paid by the Customer.

3. PRICES

All prices on focused.nu website are in Euros (EUR). The prices of the products do not include shipping costs, which will be calculated at the moment of purchase. Total costs will be indicated in the confirmation of the order. All product prices include 21% VAT. If the Customer is resident outside the European Union he/she is responsible for payment of applicable taxes and custom fees according to the relevant country’s policy.

The prices can vary at any time, especially in case of a special offer, promotions or any other marketing efforts. KULT.re does its best to ensure that all pricing information on the focused.nu website is accurate, but cannot guarantee the absolute absence of error. In the event that an error in the price of a product shall occur, KULT.re will allow the Customer the option to confirm the purchase of the Product at the correct price or to cancel the order. If KULT.re is unable to contact the customer the order will be treated as cancelled.

4. ORDER

The details and the price of the Product are detailed in the product’s description. The Customer shall choose the Product by pushing the “buy” button, after having reviewed and accepted the shipping expenses and the Terms and Conditions, and he/she shall choose the manner in which he/she wishes to pay and proceed the order. The order submitted by the Customer shall be binding for KULT.re only if the entire purchase procedure has been duly and correctly completed without any error. KULT.re will send the Customer an e-mail confirming the receipt of the order placed. The Customer shall verify the content of the e-mail and shall notify KULT.re of any error or other mistake.

5. PAYMENT

The price is payable upon placement of the order. The customer undertakes to pay the total price of the products and shipping costs as stipulated on the Site and also to pay for the customs duties, the VAT or any other taxes due to the import of products in the country of delivery.

The Customer shall pay for his order by paypal or bank transfer in advance. KULT.re reserves its right to claim the return of the ordered products in case of non-payment. Under those circumstances, and upon KULT.re request, the customer shall return any product for which the payment has not occurred. The customer shall pay for any costs in connection therewith. 6. SHIPPING AND DELIVERY FOCUSED

products are delivered to the address indicated by the Customer in the order form. Please fill in your address carefully to avoid delivery problems.

KULT.re ships in Europe using a fixed price, which depends on the weight, the volume and the destination. International shipping is available. Shipping quotes are made on a per order basis and dependent on destination. If you are interested in placing an order that requires international shipping please contact us at info@focused.nu. Shipping costs are in any case indicated to the Customer before he/she confirms the order.

Once payment has cleared, we will start the production of your FOCUSED product. We generally ship orders within 30 to 40 business days, unless otherwise indicated. Once your order has shipped, you will receive an email notification with tracking information.

Delivery times should take between 2-3 days for The Netherlands and from 3-10 days elsewhere, depending on the destination. If the FOCUSED product ordered is not available or is out of stock, KULT.re undertakes to inform the Customer as soon as possible and to indicate when the product will be available. The Customer may, at its option, wait for the availability of the product or request a refund.

Delivery shall be deemed to have been made when the FOCUSED products are delivered to the carrier. The delivery note given by the carrier, dated and signed by the Customer upon delivery will constitute evidence with regard to transport and delivery. In the event of undelivered FOCUSED products due to Customer absence or wrong address, the products will be returned to KULT.re which reserves its right to then cancel the order and refund to the Customer the price of the FOCUSED products, the postage costs and any costs of returning the product to KULT.re remaining payable by the Customer.

7. SHIPPING DAMAGES

Even though FOCUSED items are packaged properly, transit-related damage can occur. All FOCUSED shipments are insured against loss or damage. When an order arrives, please inspect it carefully. If you notice any damage to the boxes please notify us immediately (within 24 hours) at info@focused.nu for further instructions. Claims will require original packaging and following digital photos:

1. A picture of the complete outside of the box, clearly showing the parcel label.
2. A picture of the opened box, clearly showing the content and the interior packing.
3. A picture of the complete size of the article.
4. A detailed picture (close-up) of the actual damage of the article.

We will do everything we can to assist you with your claim.

8. WARRANTY & RETURN

The warranty period specified by law applies. In the event of a FOCUSED product fault that is covered under the terms of the warranty, we shall repair the products, supply a replacement or refund the purchase price at our discretion.
KULT.re offers a high quality product. We take great care in making each FOCUSED piece. We inspect all pieces prior to shipment to make sure it is perfect before shipping to our customers. If a shipment arrives with the appearance of shipping damage or a manufacturing defect, please notify us immediately (within 24 hours) at info@focused.nu and we will do our best to resolve whatever issue there is as quickly as possible.

If the Customer is not satisfied with the FOCUSED product he/she can return it within fourteen (14) working days of delivery receipt. The Client must inform KULT.re by e-mail about the return. KULT.re reserves the right to refuse a returned FOCUSED product if the Customer has not contacted us beforehand. Any goods returned must be unused and undamaged, and must be returned in their original packaging. KULT.re is unable to accept returns or offer an exchange or a refund for items that are not returned in exactly the same condition that they were purchased.

If KULT.re accepts a returned FOCUSED product, it shall refund the purchase price less any shipping fees to the Customer within thirty (30) days from date at which KULT.re receives the returned product(s). The delivery costs are not refundable. KULT.re will not be held responsible for the refund or the compensation of FOCUSED Products that have been lost, stolen or damaged.

Any kind of warranty will be void if a defect is caused by the Client as a result of natural wear, wear related to usage, improper or inappropriate use, improper storage or maintenance by the Client, accidental damage, exposure to sunlight, modifications and changes to the product made by the Client and improper treatment of surfaces using unsuitable cleaning and polishing agents. The Client is not entitled to warranty if the defect is caused by or arising from circumstances where KULT.re has no effect on, including weather conditions (such as but not limited to, extreme temperatures or rainfall) and relative air humidity.

9. PERSONAL INFORMATION

KULT.re collects minimum amount of personal information in order to handle orders, deliver products and process payments and refunds. Contact details of the Customers are kept only in the KULT.re database with aim to send personal offers and news. If the Customer does not appreciate KULT.re making any personal offers or news, he/she can let KULT.re know in writing (info@focused.nu). Customer will not receive any mailing or other forms of FOCUSED news and advertising any more.

10. LAW AND JURISDICTION

These terms and conditions shall be governed by and construed in accordance with Dutch law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the competent court in Rotterdam, the Netherlands.
